FORCED INTERVENTION

There are situations where, although we don’t want to be involved in a particular dispute, our introduction in that case is necessary to resolve the process, despite the opposing parties.

In this regard, we bring to your attention the notion of FORCED INTERVENTION, a legal institution which consists in introducing a third party in the trial by the judge on his own initiative in the situations expressly provided or making the parties aware of the need for the introduction of a third person in the trial.

It is important to note that if the party objects and the judge considers that the case can’t be solved without the participation of the third party, he will reject the action.

A concrete example is the situation of a road traffic accident which the victim makes a claim for compensation against the insurance company, in which case the person responsible for the accident must be brought into the trial.
