THE SIGHT WINDOW AND THE LIGHT WINDOW and the legal consequences that they produce

As we are well aware, the right of ownership coerce the owner both to the respect of the environment and  to the respect of the good neighborhood, but regarding this latter constant aspect, there are some disputes in our relations with the neighbors.

As a consequence, we want to make you aware of the difference between the following notions: THE SIGHT WINDOW AND THE LIGHT WINDOW and the legal consequences that they produce.

THE SIGHT WINDOW can be built with a distance of at least 2 meters between the nearby property and the window you are building, if the window is oriented to it. Otherwise, if they are non-parallel, you can build the window with the obligation to respect a distance of at least 1 meter.

THE LIGHT WINDOW can be built, as opposed to the SIGHT WINDOW without the limit of distance between this and your neighbor’s property, the only condition though, is to prevent the view to the neighbor’s property.

Therefore, when a dispute arises regarding the neighborhood relations and the keeping of the minimum distance between your window or the neighbor’s window and the neighboring property, it is important to consider the type of construction and the legal effects produced in order to file a claim for trial or a well-founded defense.
