the Order of the National Agency for Employment (ANOFM) no. 286 of 17.02.2020

On 26.02.2020 entered into force, through the publication în the Oficial Monitor, the Order of the National Agency for Employment (ANOFM) no. 286 of 17.02.2020 on the modification and completion of the procedure for receiving and resolving the job applications or the unemployment benefits.

The procedure for receiving and resolving the job applications or the unemployment benefits was initially approved by the Order of the President of the National Agency for Employment no. 85/2002 for the purpose of regulating the way of implementing the provisions of art. 16 of Law no. 76/2002 regarding the unemployment insurance system and the stimulation of employment.

In accordance with the new amendments regulated by this Order, the beneficiaries covered by the law on the unemployment insurance system and the stimulation of employment, who are entitled to address the local agencies of the ANOFM structure in order to obtain its competition for their distribution in the field of work, have to follow a much simplified procedure for obtaining a job or for acquiring the unemployment benefit.

In this regard, under the conditions of employment, the applicant may no longer submit to the local employment agency the medical care certificate from which to result his medical aptitude for the concerned employment,  being sufficient a declaration on his own liability, under the sanction of the crime of false statements, from which to result that there are no medical restrictions for the performance of an employment activity.

Also, the persons who cannot be introduced in the field of work, but who fulfill the conditions for obtaining an unemployment benefit, will attach to the request for granting this type of benefit, by similarity, along with the other documents requested by the law, the declaration on their own responsibility regarding their medical situation, instead of their medical care certificate.

Last but not least, the applicants can obtain the model of the declaration on their own responsibility previously mentioned in Annex no. 1 ^ 1 of the Order of the president of ANOFM no. 85/2002 amended by the regulations of Order no. 286 of 17.02.2020.
